Terms of Service

These Terms of Service ("Terms") govern your use of Tekel (the "Service"): its general website (the home page, Domains, The standard, How it works, Pricing, Providers, the legal pages and the Dental location chooser at /dental) and Tekel Dental in New York and Florida. Tekel is operated by FormaNex LLC, a limited liability company registered in Georgia, USA. In these Terms, "Tekel," "we," and "us" mean FormaNex LLC as the operator of the Service. By using the Service you agree to these Terms. If you do not agree, do not use the Service. Privacy at Tekel explains how we handle personal information.
1. Where these Terms apply
For Tekel Dental, the Dental Terms of Service for New York and for Florida, also linked from each state's Dental pages, follow these Terms and add the details of the dental service (directory listings, Smart Match and appointment requests) and that state's own provisions, including which law governs. Where they differ from these Terms, the state's Dental Terms control for that service. Tekel Dental in Israel has its own Terms in English, Hebrew and Russian, linked from its pages; these Terms do not apply to it.
2. What Tekel is
Tekel is an independent technology platform that helps people find professionals, starting with dentists. Tekel provides information, not dental care. It is not a dentist, dental practice, insurer or emergency service, and it does not give medical or dental advice, diagnose conditions or recommend treatment. You decide which provider to contact, and any care you receive is between you and that provider.
3. Not for emergencies
If you have a medical or dental emergency, call 911 or get emergency care immediately. Do not rely on the Service to triage urgent symptoms or to arrange emergency appointments.
4. Using the Service
You may use the Service for your own personal, non-commercial purposes. You must be at least 18 years old, or use the Service under the supervision of a parent or legal guardian, and be able to form a binding contract. You agree not to:
- use the Service unlawfully, submit false or misleading information, or impersonate another person;
- circumvent or interfere with security, rate limits or access controls, or overload the Service;
- obtain non-public data without authorisation, or copy or attempt to derive Tekel's software, matching technology or scoring;
- scrape, harvest or extract directory listings or other content in bulk, or republish them as a competing directory or dataset, without our written permission;
- use content from the Service to train or improve an artificial-intelligence or machine-learning model without our written permission.
Search engines and AI-assisted tools may read our public pages so that people can find them, consistent with the crawler controls we publish (such as robots.txt). Any tool or interface Tekel provides gives access only to what that interface is designed to return; it does not permit bulk extraction of provider data. This permission does not mean that Tekel offers, or has approved, an integration with any particular assistant.
5. Ownership
The Service, including its software, design, text, matching technology and the compilation of directory information, is owned by Tekel or its licensors and protected by intellectual-property law, subject to third parties' rights in source material. Tekel™ and the Tekel logo identify Tekel's services. We grant you a limited, personal, non-exclusive, non-transferable permission to use the Service. Where the law allows, we may withdraw that permission, for example if you breach these Terms. All other rights are reserved.
6. Disclaimers, limitation of liability and indemnification
We do not guarantee that any provider is available, accepts your insurance, holds any particular licence or credential, or will achieve any outcome, or that the Service will be uninterrupted or error-free.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE EXTENT PERMITTED BY LAW, TEKEL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, AND IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR THE ACTS OR OMISSIONS OF ANY PROVIDER YOU FIND THROUGH THE SERVICE. NOTHING IN THESE TERMS LIMITS LIABILITY OR CONSUMER RIGHTS THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
You agree to indemnify and hold Tekel harmless from claims, damages and expenses arising out of your misuse of the Service or your breach of these Terms.
7. Changes
We may change the Service or these Terms. We publish the current Terms on this page with their date. For a material change we will give notice where appropriate, for example on the Service, and ask for your agreement where the law requires it. Otherwise, continuing to use the Service after a change takes effect means you accept it.
